Civil litigation: Failure to yield leads to fatal collision

Motor vehicle accidents can be dangerous events that have the potential to leave those involved with serious injuries, or worse. Families who lose loved ones under similar circumstances due to the negligence of another party may wish to pursue restitution, potentially prompting a need for assistance during subsequent litigation. A recent accident in North Carolina has claimed the life of a 93-year-old woman, and left another party facing criminal charges.

According to reports, the incident took place on a recent Friday, when the driver of a vehicle failed to yield when making a left turn, resulting in a collision with an oncoming car. The force of the impact caused the car to overturn, and injured the driver and a passenger. The driver was taken to the hospital for treatment, but the woman who was riding in the car was pronounced dead soon thereafter.

Three passengers in the initial vehicle were also taken to the hospital, and the driver has reportedly been charged with misdemeanor death by motor vehicle and failure to yield. Traffic lights and signs are in place at intersections to control the flow of traffic and increase safety, and should a driver choose to ignore them, the result can be catastrophic. Should similar actions lead to the death of another party, his or her surviving family members could be left in search of answers, and justice.

Losing a loved one in a fatal collision can be a stressful and daunting experience, and can leave a family facing numerous hardships. Those who experience a similar situation may find it beneficial to speak with an attorney with experience in complex civil litigation for advice on how best to proceed. An attorney can assist a client in North Carolina in pursuing the compensation to which he or she is entitled through a wrongful death claim against the party deemed at fault.
