First Offense DWI Exceptional Counsel & Resolute Advocacy

First-Offense DWI in Winston-Salem

Defense Shaped by DWI Prosecution & Testing Experience

A first DWI arrest calls for careful review of the traffic stop, sobriety tests, chemical test results, and factors that could affect sentencing. At Grace, Tisdale & Clifton P.A., we defend people charged with DWI in Winston-Salem and the surrounding areas, drawing on experience from both sides of criminal cases.

D. Kenneth Tisdale, Jr. served as an Assistant District Attorney in Winston-Salem from 1997 to 2002. He prosecuted DWI cases and felony trials and holds field sobriety testing certification. Most of our defense lawyers are former prosecutors, and Christopher R. Clifton is a North Carolina Board Certified Specialist in State and Federal Criminal Law.

Immediate License Consequences After a First DWI Arrest

An arrest can trigger a civil license revocation before the criminal case is resolved. Under N.C.G.S. § 20-16.5, a driver charged with an implied-consent offense generally faces an immediate revocation of at least 30 days after refusing testing or producing an alcohol concentration of 0.08% or higher.

This civil license revocation is separate from the criminal prosecution and from the license revocation imposed after a conviction. Each consequence must be addressed on its own timeline.

Driving During the 30-Day Civil Revocation

A driver generally can’t drive during the first 10 days of the 30-day civil revocation. After that period, the driver may petition for a limited driving privilege covering the remainder of the revocation if the legal requirements are satisfied.

Conditions commonly considered for that limited privilege include:

  • Holding a valid driver’s license at the time of the alleged offense.
  • Having no prior DWI conviction within the preceding seven years.
  • Providing proof of insurance.
  • Completing an alcohol assessment.

Consequences of Refusing a Chemical Test

Refusing a chemical test carries a separate one-year license revocation that can remain in effect even if the driver is later found not guilty of DWI. Because testing and license issues follow procedures distinct from the criminal prosecution, they require prompt, individualized review.

North Carolina DWI Sentencing Levels

A first-offense DWI is a misdemeanor under N.C.G.S. § 20-138.1, but it isn’t sentenced under North Carolina’s general misdemeanor grid. Instead, N.C.G.S. § 20-179 establishes six sentencing levels, ranging from Level Five through Aggravated Level One.

The court determines the level by weighing grossly aggravating, aggravating, and mitigating factors. Most true first offenses without grossly aggravating factors fall within Level III, IV, or V, but the arrest facts and the driver’s record determine the applicable level.

Potential sentences at these levels include:

  • Level V: 24 hours to 60 days in jail and a fine of up to $200.
  • Level IV: 48 hours to 120 days in jail and a fine of up to $500.
  • Level III: 72 hours to six months in jail and a fine of up to $1,000.

Grossly aggravating factors can elevate a first offense to Level II or Level I, where the required active jail terms can’t be suspended. A first conviction also results in a one-year administrative license revocation, distinct from the immediate civil revocation that may follow the arrest.

What to Expect in a Forsyth County DWI Case

Criminal district and superior court cases in Forsyth County are heard at the Forsyth County Courthouse in Winston-Salem. The county is part of Prosecutorial District 31. After a DWI arrest, booking and magistrate proceedings occur before the criminal case moves through the court process.

A first-offense DUI in Winston-Salem commonly requires attention on two tracks: the criminal prosecution and separate driving-privilege proceedings. Court appearances, evidence review, negotiation, and trial preparation are distinct stages. The demands of each stage depend on the evidence, court schedule, and decisions made as the case develops.

Evidence We Examine After a First-Offense DWI Arrest

We first examine why the officer initiated the traffic stop and whether the available facts supported each subsequent step. Our review can include arrest records, officer reports, video, roadside test documentation, and chemical testing records. Roadside sobriety exercises and chemical tests are separate evidence categories governed by different procedures and documentation.

D. Kenneth Tisdale, Jr.’s field sobriety testing certification informs our review of how roadside exercises were instructed, administered, and recorded. His prior work prosecuting DWI cases also provides practical insight into how the state may organize and present its evidence.

Issues requiring close review may include:

  • The Traffic Stop: The stated reason for stopping the vehicle and the officer’s documented observations.
  • Field Sobriety Testing: The instructions, testing conditions, administration, and reported observations.
  • Chemical Tests: The type of test, applicable procedures, reported result, or alleged refusal.
  • Sentencing Factors: The driver’s record and circumstances that may affect the applicable DWI sentencing level.

Our criminal defense attorneys have represented thousands of clients throughout North Carolina in matters ranging from misdemeanor charges to complex federal cases. We apply that experience to the specific facts rather than assuming every first arrest presents the same defense options or consequences.
